Is streaming music from Grooveshark.com legal?

I read that EMI filed a copyright infringement lawsuit against Grooveshark in May, so I'm wondering if that means that it's illegal to stream music from this website? If so, looks as if it's back to Napster or Youtube. I'd rather not risk any legal action.
